I. Harbor dues in the seaports of Vostochny and Nakhodka

1. Rates of harbor dues in the seaports of Vostochny and Nakhodka


     According to Ministry of Transport order dated 31.10.2012 № 387 «On approving list of harbor dues in the seaports of the Russian Federation» the FSUE “Rosmorport” Vostochny Branch charges the following harbor dues in the seaports of Vostochny and Nakhodka:

2. Rules of application of harbor dues rates charged by FSUE “Rosmorport” in the seaports of Vostochny and Nakhodka


     Harbor dues are paid by Russian and foreign vessels calling at the seaports of Vostochny and Nakhodka or leaving these seaports, and also vessels crossing the water area of these seaports by transit. 
     Vessel harbor dues rates are set for the Russian foreign shipping vessels, foreign vessels, and for Russian vessels in cabotage, and are differentiated by the vessel types: 
       - all vessels, except trailer, floating, container and tanker vessels; 
       - trailer, floating, and container vessels; 
       - tanker vessels. 
     The type of vessel is defined by the vessel documents. The nationality of vessels is defined by the flag under which it sails, regardless of its owner or manager. The nationality of a barge towing arrangement is defined by the flag of its self-propelled part. 
     The harbor dues rates are set for a unit of gross registry tonnage (GT), stipulated in the International Measurement Certificate of the vessel, according to the International Convention on Tonnage Measurements of Ships (London, June 23, 1969). 
     Harbor dues for tankers with isolated ballast tanks are counted without regard to the gross tonnage of the isolated ballast tanks indicated in the Measurement Certificate. 
     If the Measurement Certificate says nothing about the gross tonnage of the isolated ballast tanks, and consequently, the decreased gross tonnage of the tanker, then harbor dues are counted with a 0,9 ratio. 
     In order to count harbor dues, a passenger vessel with gross tonnage more than 40000 GT is considered equal to gross tonnage of 40000 GT. 
     Harbor dues for vessels without Measurement Certificates are estimated by a relative tonnage in cubic meters which is equal to product of three numbers – maximum length, maximum width, and maximum board height of the vessel, and with a 3.5 ratio 
     Harbor dues for vessels calling at the seaports of Vostochny and Nakhodka are paid according to the passage by which the vessel called at this seaport. When a vessel is leaving a seaport, harbor dues are paid according to the passage by which the vessel left the seaport. Ecological dues are paid by passage (cabotage or foreign) by which the vessel entered the seaport. 
     A vessel presented to a seaport in ballast pays harbor dues (including the ecological dues) according to passage for which it was presented. A vessel leaving a seaport in ballast pays harbor dues according to the passage by which it called at this seaport. 
     A vessel calling at the seaports of without performing cargo and passenger operations, and also crossing a seaport water area in transit pays harbor dues according to the passage (cabotage or foregin) rates, with regard to the latest seaport (Russian or foreign) which it called at. 
     Harbor dues for vessels calling at the seaports without performing cargo and passenger operatins, crossing a seaport water area in transit (except navigational dues (VTS), and pilotage dues), excluding cases stipulated in the points 1.12, 1.14 of the FTS of Russia order dated 20.12.2007 № 522-т/1 (as amended and supplemented), are paid with the 0.5 ratio. 
     The gross tonnage of barge towing arrangements, caravans, and other combined floating objects when counting the harbor dues (except ecological dues) is defined as the sum of gross tonnages of all elements of the combines floating objects. When counting ecological dues only the gross tonnage of the self-propelled part of the object is taken into account. 
     Harbor dues for lighter carrier ships performing cargo operations with lighters in the inner and outer harbor, are counted according to the sum of gross tonnages of the lighters, which were submitted by the lighter-carrier when calling at the seaports, and received by it when leaving a seaport. 
     All the harbor dues are not charged from: 
       - training ships; 
       - training auxiliary vessels on the balance of educational establishments of marine and river transport; 
       - vessels designed for state supervision and control functions; 
       - auxiliary and technical vessels, harbor vessels working within the water area and equipped anchoring berths of one seaport or adjoining water areas of several seaports; 
       - Russian navy, and navy auxiliary ships; 
       - hospital ships; 
       - emergency vessels, including ships for oil leaks liquidation; 
       - ice-breakers; 
       - hydrographic ships; 
       - excursion and leisure boats of coastal shipping. 

     All harbor dues, except pilotage dues, are not charged from: 
       - scientific and exploration ships; 
       - sport, leisure and other self-propelled boats with main engine power less than 5 kW; 
       - foreign navy ships; 
       - vessels on sea trial; 
       - boats transporting passengers between the harbor and the berths of a seaport. 

     Vessels listed in chapters 1.11 and 1.12 of the FTS of Russia order dated 20.12.2007 №522-т/1 (as amended and supplemented), except vessels transporting passengers between the harbor and the berths of the seaports of a seaport, are not exempt from harbor dues, if they perform cargo and passenger operations, and also towage between these seaports, if they do not have adjoining water areas. 

     All harbor dues, except pilotage dues and navigational (VTS) dues, are not charged from: 
     - vessels coming from sea to the outer harbor of a seaport and leaving from the outer harbor to the sea withour performing any operations in the harbor; 
     - vessels, which have to call at a seaport due to a threat to safety of further navigation, to life or health of the crew and passengers, without performing any cargo or passenger operations in the seaport; 
     - vessels calling at a seaport for emergency repairs without performing any cargo or passenger operations in the seaport. 

     Vessels leaving a seaport under decision of seaport management and in order to execute deviation works, with further return to the seaport, are exempt from repeat payment of harbor dues, except pilotage dues. 
     Fishing fleet vessels pay harbor dues according to the cabotage rates for all vessels, except trailer, floating, container and tanker vessels. 
     The harbor dues mentioned above are baseline, and are used with ratios indicated in the terms of application of certain harbor dues. If several ratios should be applied to a vessel, they are consequently multiplied.

Canal dues

     Canal dues are charged when a vessel goes through a canal to call at the Vostochny seaport and to leave it. 
     Passenger vessels pay full canal dues in the Vostochny seaport one time a calendar year for the first call at the Vostochny seaport and the exit from the seaport. 
     From the second call at the Vostochny seaport passenger vessels (except from cabotage voyages) pay canal dues with a 0.25 ratio applies to the established rates for each call at and exit from the Vostochny seaport.  

 

Pilotage dues

     Pilotage assistance in the seaports of Vostochny and Nakhodka is compulsory for all Russian and foreign vessels, and is rendered all the day round by the FSUE “Rosmorport” Vostochny Branch and other economic entities providing pilotage services in the Nakhodka seaport. 
     Pilotage dues are charged in the seaports of Vostochny and Nakhodka for pilotage assistance beyond the seaport (pilotage assistance on the approaching canals and fairways), and pilotage assistance within the seaport. The borders of outer and inner pilotage assistance zones in the seaports of Vostochny and Nakhodka, and also terms and conditions of rendering pilotage services by the pilots of the FSUE “Rosmorport” Vostochny Branch are stipulated in the section “Pilotage Services of the Vostochny Branch”
     Pilotage dues include payment for transporting a pilot to and from the vessel. 
     During outer pilotage assistance (except sport and small-sized vessels) pilotage dues are charged for each mile. An incomplete mile is equal to full mile. 
     During inner pilotage assistance pilotage dues are charged for each operation. The following actions are considered to be a sole operation: 
       1) pilotage assistance to the vessel in the inner water area of a seaport with further anchoring, mooring or berthing when the vessel calls at the seaport; 
       2) deberthing with further pilotage assistance in the inner water areas of a seaport when the vessel leaves the seaport; 
       3) deberthing or mooring while moving the vessel between the berths and inner harbors, or berths and outer harbors; 
       4) pilotage inwards or outwards the dock. 
     During inner pilotage assistance outwards to the canal, or fairway, an additional pilotage due is charged at the rate of outer pilotage assistance for each mile. 
     In order to estimate pilotage dues, a vessel with the gross tonnage less than 1400 GT (except sport and small-sized vessels) is considered equal to a vessel with the gross tonnage of 1400 GT. 
     When shifting a vessel for a distance smaller than the vessel length with a pilot onboard, pilotage dues are charged at the rates of inner pilotage assistance with a 0.5 ratio. 
     If a pilot commissioned to vessel is refused to render services, 50% of corresponding pilotage dues are charged. 
     For cargo vessels working on the lines opened according to the established procedure the 0.8 ratio is applied to pilotage dues rates.
 

Lighthouse dues

     Lighthouse dues are charged from vessels calling at the seaports of Vostochny and Nakhodka and leaving these seaports.

Navigation dues

     Navigation dues are charged in the seaports of Vostochny and Nakhodka for each port call and port exit.
     Information on coverage area of the Vostochny and Nakhodka seaports VTS and terms and conditions of rendering navigation services by the Vostochny Branch with the help of VTS can be found in the section “Navigation Services of the Vostochny Branch”.
     Cargo vessels, which perform loading and unloading in the seaports of Vostochny and Nakhodka during one passage, pay full navigation dues in these seaports, if it is the first seaport of the passage, or with a 0.5 ratio applied to the established rates, if the seaports of Vostochny and Nakhodka are not the first seaports in the passage.
     Passenger vessels pay navigation dues in the seaports of Vostochny and Nakhodka for the first port call and first port exit one time a year at the rate of navigation dues.
     From the second port call in the seaports of Vostochny and Nakhodka, passenger vessels pay  navigation dues at the rate of navigation due (VTS) for each port call and port exit.
     For cargo vessels working on the lines opened according to the established procedure the 0.8 ratio is applied to navigation dues rates.
 

Ecological dues

     Ecological dues are charged from all vessels in the seaports of Vostochny and Nakhodka, which have necessary equipment for receiving all types of shipboard wastes (except ballast waters), for the whole time if the vessel being in the seaports. 
     Vessels which did not dump their wastes are not exempt from payment of ecological dues.
Shipboard wastes are received by the FSUE “Rosmorport” Vostochny Branch with the necessary transport and equipment for receiving, transporting, and disposing shipboard wastes. Terms and conditions of rendering ecological services by the Vanino Branch can be found in the section “Ecological Services of the Vostochny Branch” http://www.rosmorport.ru/vof_serv_eco.html. 
     For vessels equipped with the environmental protection equipment and using it for disposition of all types of shipboard wastes, and which have the certificates on prevention of sea pollution by oil, sewage, and waste a 0,5 ratio is applied to ecological dues rates. 
     Terms and conditions of vessels inspection for presence of necessary environmental protection equipment, in order to apply the decreasing ratio to the ecological due rate, are described in the section “Ecological Services of the Vostochny Branch” http://www.rosmorport.ru/vof_serv_eco.html. 
     Ecological dues are not charged from: 
       - vessels calling at the seaports of Vostochny and Nakhodka without performing any cargo and passenger operations; 
       - vessels performing cargo or other operations only in the outer harbor of the Vostochny and Nakhodka seaports; 
       - non-self-propelled vessels 
 

3. Terms and conditions of harbor dues payment to the FSUE “Rosmorport” Vostochny Branch


     Harbor dues charged by the Vostochny Branch in the seaports of Vostochny and Nakhodka can be paid by the ship owners through sea agents operating in the corresponding seaports, or directly to the Vostochny Branch. 
     In order to pay harbor dues, a sea agent/ship owner needs to negotiate a contract with the Vostochny Branch on payment of harbor dues in the seaports of Vostochny and Nakhodka (hereinafter referred to as – Contract). 
     To negotiate a Contract the sea agent/ship owner should file a Contract Application Form  to the Vostochny Branch by fax: +7 (4236) 66-54-28, or e-mail: mail@vf-rmp.ru. The application form is to be reviewed within a day. After that, if all necessary documents are submitted by the ship owner/sea agent, the Vostochny Branch shall send two copies of the Contract to the sea agent/ship owner for signing by mail, or courier. An original copy of the Contract signed by the sea agent/ship owner shall be returned to the Vostochny branch.

     Harbor dues are paid by the sea agent/ship owner according to the terms and conditions established by the Contract. 

     In special cases for paying harbor dues for a single port call by the ship owner, or his/her official representative without negotiating a contract, it is necessary to file an Invoice Application Form signed by the ship owner or his/her official representative to the Vostochny Branch by fax: +7 (4236) 66-54-28, or e-mail a scanned copy to: mail@vf-rmp.ru. It is better to file a properly made application form three days before the vessel call at the seaports of Vostochny or Nakhodka. 
     A copy of complete harbor dues invoice is send by fax to the ship owner or his/her legal representative within one day from the filing of application. An original copy of invoice can be received from the Finance and Economics Department of the branch situated at 47 (second floor) Vnutriportovaya St., p/o Vrangel-1, Nakhodka, Primorye Territory on working days from 8:15 till 17:15 local time. 
     The bill is paid in roubles by non-cash transaction. The number of the invoice issued by the enterprise must be indicated in the payment documents. 
     Harbor dues payment shall be made before the vessel leaves the port. 

     If harbor dues are not paid according to the established procedure before the vessel leaves the seaports of Vostochny or Nakhodka, the Vostochny branch has the right to request the seaport captain to refuse to issue a port exit permit according to subparagraph 4, paragraph 1, chapter 80 of the Trade Shipping Code of the Russian Federation. 


II. Tariffs for other services rendered by the FSUE “Rosmorport” Vanino Branch


Towage services

     The FSUE “Rosmorport” Vostochny Branch provides towage services in the seaport of Vostochny. 

     Cost of towage by Olimp tow-tug is the following: 
       - for foreign shipping vessels: 2.025 RUR for 1cub. m of relative vessel capacity;
       - for cabotage shipping vessels: 1.247 RUR for 1cub. m of relative vessel capacity. 
     Relative vessel capacity is defined by multiplication of the three dimensions of vessel – maximum length, maximum width and maximum board height of the vessel indicated in its shipping documents. 
     Payment for these services is exempt from VAT, according to subparagraph 23, paragraph 2, article 149 of the Tax Code of the Russian Federation. 

     Terms and conditions of towage services are defined by clauses of an appropriate contract made according to the established procedure described in the section “Towage Services of the Vostochny Branch”.  

Ecological services

     The Vostochny Branch renders the following ecological services in the seaports of Vostochny and Nakhodka: 
       - services on cleaning berth water areas from floating wastes and oil products; 
       - additional services on collecting shipboard wastes from vessels exempt from obligatory collection of wastes and payment of ecological dues in the seaports of Vostochny and Nakhodka, and also collecting wastes from organizations operating in Vostochny and Nakhodka seaports; 
       - services on booms setting around vessels; 
       - services on liquidation of emergency oil, and/or oil products leaks in the water areas of the seaports of Vostochny and Nakhodka. 

     a) the cost of services on cleaning berth water areas from floating wastes and oil products in the seaports of Vostochny and Nakhodka with the help of an oil garbage removal vessel of the Vostochny Branch is 2,194.8 RUR, VAT included, per one hour of its work. 

     b) the cost of additional services on collecting shipboard wastes from vessels exempt from obligatory collection of wastes and payment of ecological dues in the seaports of Vostochny and Nakhodka, and also collecting wastes from organizations operating in Vostochny and Nakhodka seaports is the following:

      c) the cost of setting and taking out one boom section with the help of the client’s transport is 359 RUR (Vat excluded), the cost of stay of a boom section is 1 RUR per hour (VAT excluded).
If a client does not have boom-setting transport (vessels), it is possible to use vessels of the Vostochny Branch.
     The cost for using the Vostochny Branch vessels for setting and taking out booms is the following:

     d) the cost of services on liquidation of emergency oil, and/or oil products leaks depends on working time and number of Vostochny Branch floating facilities in use, and also from the amount of used material (sorbent). The cost for 1 kilo of sorbent is 150 RUR.
     The cost for using the Vostochny Branch vessels and equipment for localization and extinguishing emergency oil and/or oil products leaks is the following:
