Ministry of Transport of the Russian Federation approved Rules of Issuance of Insurance Certificates of Civil Liability for Bunker Oil Pollution Damage

With a view of realization of International Convention on Civil Liability for Bunker Oil Pollution Damage, 2001 (hereinafter referred to as “the Convention”) by the Russian Federation, Federal law from December, 3rd, 2008 № 230-FZ “About Accession of the Russian Federation to International Convention on Civil Liability for Bunker Oil Pollution Damage, 2001” and item 5.2.53.42 of Statutes for Ministry of Transport of the Russian Federation, by the order of Ministry of Transport of the Russian Federation from February, 25th, 2010 № 42 Rules of Issuance of Insurance or other Financial Support Certificates of Civil Liability for Bunker Oil Pollution Damage (hereinafter referred to as “the Rules”) were approved.

The Rules define the procedure of issuance of insurance or other financial support certificates of civil liability for bunker oil pollution damage by captains of seaports for vessels under the National flag of the Russian Federation, and also for vessels registered in the states which are not participants of the Convention.

Each vessel with gross tonnage over 1 thousand units, entering or leaving ports of the Russian Federation or arriving to/departing from a coastal construction in the territory of the Russian Federation, should have the certificate of insurance or other financial support in the form of bank or other credit organization guarantee for covering the liability of the proprietor of the vessel for bunker oil pollution damage.

The order of Ministry of Transport of Russia comes into force in 10 days after the date of its official publication.
