By the decision from 07.08.2009 for the case № A40-36609/09-92-209 the Arbitration Court of Moscow recognized as illegal in full the instruction of Federal Service of Financial and Budgetary Oversight Territorial Department for Moscow, that was made as a result of inspection of certain aspects of FSUE “Rosmorport” financial and economical activity.

By the order from 17.11.2009 the Ninth Arbitration Appellate Court recognized the conclusions of the court of first instance as legitimate and left the decision without changes.

Having disagreed with the decision and order of court of appeal instance Federal Service of Financial and Budgetary Oversight Territorial Department for Moscow appealed against them in a cassation order.

By the decision from 25.02.2010 Federal Arbitration Court of Moscow District confirmed legitimacy of FSUE “Rosmorport” actions concerning the conclusion of four state contracts, leasing of federal property under rent contracts, reception of money by property usage without conclusion of rent contracts, and left the court decisions on the given case without change, and the appeal of Federal Service of Financial and Budgetary Oversight Territorial Department for Moscow without satisfaction.
