2. Terms of Application of the Rates of Harbor Dues Charged by FSUE “Rosmorport” from Vessels in the Seaports of Anadyr, Beringovsky, Egvekinot, Pevek, and Providenya

 

     The rules of application of the rates of harbor dues in the seaports of the Russian Federation are determined by Order of FAS of Russia No 223/16 dated 10.03.2016 with the specifications established by Order No. 711/16 of June 6, 2016 of the FAS of Russia and Order No. 1588/19 of December 3, 2019 of the FAS of Russia, as well as Orders of FSUE “Rosmorport” No. 555 of 15.12.2020 (amended on 16.12.2021, on 08.06.2022, on 16.12.2022) and No. 546 of 27.12.2019 (amended on 15.12.2020, on 16.12.2021, on 08.06.2022, on 16.12.2022).

     Russian or foreign owners of vessels or their authorized persons pay harbor dues for a vessel's call to the seaports of Anadyr, Beringovsky, Egvekinot, Pevek, and Provideniya and a vessel's exit from the seaports, as well as a vessel's transit in the water areas of the corresponding seaports.

     Harbor dues in the seaports of Anadyr, Beringovsky, Egvekinot, Pevek, and Provideniya are established for Russian vessels carrying navigation under the flag of the Russian Federation (further Russian vessels) and vessels carrying navigation under the flags of foreign states (further foreign vessels).

     The rates of harbor dues in the seaports of Anadyr, Beringovsky, Egvekinot, Pevek, and Provideniya are established for Russian vessels in foreign shipping and for foreign vessels, as well as for Russian vessels in coastal shipping and are distinguished by vessels' types:

  • all vessels except trailers, floating vessels, containers and tanker vessels;
  • trailers, floating vessels and containers;
  • tanker vessels.

     Foreign vessels sailing coastwise pay harbor dues at the rates established for foreign vessels in foreign shipping.

     The flag and the type of a vessel are defined by vessel documents.

     For the purpose of applying the rates of harbor dues the flag of tug/barge towing convoy is defined by the flag of the carrier.

     The rates of harbor dues are established in rubles.

     The rates of harbor dues from vessels are established per unit of a vessel's gross registered tonnage.

     Harbor dues for tankers with segregated ballast tanks are calculated without gross registered tonnage of segregated ballast tanks that is specified in a measuring certificate.

     If the measuring certificate contains no information on gross registered tonnage of segregated ballast tanks, and consequently, on the tanker's reduced gross tonnage, harbor dues are calculated with the coefficient of 0.9.

     In order to calculate harbor dues, a passenger vessel with over 40,000 gross registered tonnage is considered equal to 40,000 gross registered tonnage.

     Harbor dues for vessels not having a measuring certificate are charged under the conditional measurement capacity in cubic meters by multiplying the three dimensions of a vessel – the length overall, the breadth overall and the depth overall specified in the vessel documents, with applying the coefficient 0.35.

     When calling at the seaports of Anadyr, Beringovsky, Egvekinot, Pevek, and Provideniya harbor dues are paid for the voyage in which the vessel was at the corresponding seaport. When a vessel leaves the seaport, harbor dues are paid for the voyage in which the vessel has called at the seaport.

     A vessel entering the seaports of Anadyr, Beringovsky, Egvekinot, Pevek, and Provideniya without cargoes pays harbor dues for the voyage during which it entered the port. A vessel leaving the seaports of Anadyr, Beringovsky, Egvekinot, Pevek, and Provideniya without cargoes pays harbor dues for the voyage in which it called at the seaport.

     A vessel entering the seaports of Anadyr, Beringovsky, Egvekinot, Pevek, and Provideniya without performing cargo and passenger operations and transiting through the water area of the corresponding seaport pays harbor dues in accordance with the rates of the current voyage (coastal shipping or foreign shipping).

     The rates of harbor dues (except the rates of pilotage dues and navigation dues in part of the vessel tracking management system – further VTS) for vessels entering the seaports of Anadyr, Beringovsky, Egvekinot, Pevek, and Provideniya without cargo handling and passenger servicing, and transiting the water area of the seaport, except the cases provided in Clauses 1.12 and 1.14 of Order of FAS of Russia No 223/16 dated 10.03.2016 are applied with the coefficient 0.5.

     When calculating harbor dues, gross registered tonnage of tug/barge arrangement, convoys and other aggregate floating facilities (including rafts) is established as the amount of gross registered tonnage of all elements of aggregate floating facilities. If certain facilities of tug/barge arrangement are of different types, harbor dues are charged separately for each part of an aggregate floating facility by using the rates for the corresponding type. In the absence of gross tonnage of floating objects, calculation is made according to conditional volumetric capacity of floating objects, estimated in cubic meters, by multiplying the three vessel's dimensions – overall length, overall breadth and depth overall indicated in vessel's documents, with coefficient 0.35. When determining the conditional capacity of a raft, its draft is taken into account instead of a raft's depth.

     Harbor dues for a cargo barge ship carrying out cargo operations with lighters are calculated based on the total gross tonnage of the lighters delivered by cargo barge ships when calling at the seaports of Anadyr, Beringovsky, Egvekinot, Pevek, and Provideniya and loaded prior to departure from the corresponding seaport.

 

     The rates of harbor dues are not applied to the following vessels:

  • training vessels, simulation training vessels, training and production vessels used for training activities;
  • vessels making government supervisory and control functions;
  • warships (including warships under a foreign flag) and military support vessels;
  • vessels designed for protecting and preserving marine environment and not used for commercial purposes;
  • vessels designated for search and rescue operations and not used for commercial purposes.

 

     The rates of harbor dues expect pilotage dues are not used for the following vessels:

  • icebreakers;
  • scientific and research vessels;
  • small size vessels;
  • leisure boats with the length of not more than 20 m;
  • sport sailing craft;
  • vessels carrying people between the roads and the port's berths with the capacity of at least 500 kW;
  • vessels making service and supply of vessels, facilities of the seaport infrastructure and working in the water area of a seaport or adjacent water areas of several seaports;
  • vessels undergoing sea trials.

     In order to conduct payments enlisted in Clauses 1.11 and 1.12 (except Clause 5) of Order of FAS of Russia No 223/16 dated 10.03.2016, the rates of harbor dues are applied in the event that they carry out operations related to cargoes and passenger servicing, as well as vessel towing between the seaports that have no adjacent water areas.

     The rates of harbor dues, except pilotage dues and navigation dues in part of VTS, are not applied to the following vessels:

  • vessels coming from sea to outer roadstead on the approaches toward the seaports of Anadyr, Pevek and Providenya and exiting from them to sea without carrying out any operations on the roadstead;
  • vessels entering into the seaports of Anadyr, Pevek and Providenya forcedly due to the threat to safety of the vessel, the crew's or passengers' life or health without carrying out operations related to cargoes and passenger handling;
  • vessels entering into the seaports of Anadyr, Pevek and Providenya for damage repairs without carrying out operations related to cargoes and passenger handling.

     Harbor dues, except pilotage dues, are not applied to vessels re-entering a port after leaving the seaports of Anadyr, Beringovsky, Egvekinot, Pevek, and Provideniya under a decision taken by the port's authorities. Such dues are not applied to carry out deviation works.

     Represented rates of harbor dues are basic rates to which coefficients specified in these Rules are applied. By applying several coefficients their consistent multiplication shall be performed.

     Russian vessels of the fishing fleet making sailings in internal sea waters, territorial sea, the exclusive economic zone and Russia's continental shelf and backward without entering foreign ports pay harbor dues in the seaports of Anadyr, Beringovsky, Egvekinot, Pevek, and Provideniya for the rates of coastal shipping.   

     Russian vessels of the fishing fleet making sailings in internal sea waters, territorial sea, the exclusive economic zone and Russia's continental shelf the purpose of which is to deliver catch of water biological resources and fish and other products for processing and its realization in the Russian Federation pay harbor dues (except for seaport water area transport security dues) in the seaports of Anadyr, Beringovsky, Egvekinot, Pevek, and Provideniya for the rates of coastal shipping with the coefficient, 0.3.

     Russian vessels with the length of 35.0 meters managing nearshore fishery in internal sea waters and in Russia's territorial sea are exempt from harbor dues in the seaports of Anadyr, Beringovsky, Egvekinot, Pevek, and Provideniya.

     Russian vessels performing fishing in the areas where Russian international treaties in the field of fishing and protecting biological resources and delivering them to the territory of the Russian Federation for the purpose of the subsequent realization and processing are in effect, pay harbor dues (except for seaport water area transport security dues) in the seaports of Anadyr, Beringovsky, Egvekinot, Pevek, and Provideniya with the coefficient 0.9.

     Russian vessels, which are equipped with facilities to store catches in live, fresh or cooled state and perform fishing in inland sea waters, in territorial waters, in an exclusive economic zone, in the continental shelf of the Russian Federation, in the areas where Russian international treaties in the field of fishing and protecting biological resources and in the open area of the World Ocean the purpose of which is to deliver catches of water biological resources in live, fresh or cooled state for subsequent realization and processing to the territory of the Russian Federation are in effect, pay harbor dues in the seaports of Anadyr, Beringovsky, Egvekinot, Pevek, and Provideniya at the rates of coastal shipping with the coefficient 0.3.

     When shipping (docking) between the ports of the Russian Federation Russian vessels (aggregate floating facilities, including rafts) moving from internal seaway (rivers' stretches of the Russian Federation) to the seaports of Anadyr, Beringovsky, Egvekinot, Pevek, and Provideniya (including seaport transit) and backward pay harbor dues for the rates of coastal shipping.

     Passenger trailer vessels, as well as trailer vessels having a passenger certificate, pay harbor dues for the rates and rules applied to trailer vessels

     Vessels navigating between non-adjacent water areas of the seaport of Anadyr in case of obtaining a permission for multiple short-term exit from the seaport and entrance to the seaport of Anadyr, provided in Compulsory regulations in the seaport of Anadyr, pay harbor dues once at first exit from the seaport and entrance to the seaport of Anadyr and in accordance with this permission.

     In case of getting a permit for multiple short-term exit from the seaport of Anadyr and entry into the seaport in accordance with the Compulsory Regulations in the Seaport of Anadyr vessels navigating between non-adjacent water areas of the seaport of Anadyr pay harbor dues once during the first exit from the seaport of Anadyr and entering the seaport pursuant to the specified permit.

 

Pilotage Dues

 

     The Anadyr Branch renders pilotage services in the seaports of Anadyr, Pevek and Providenya.

     Pilotage dues are charged for a vessel's pilotage within the specified area of compulsory (non-compulsory) pilotage for a vessel call at the seaports of Anadyr, Pevek and Providenya, departure from the seaports, navigation in the seaport water area or transiting through the water area of the corresponding seaport and for each pilot operation that finishes/starts pilotage specified in Order of FAS of Russia No 223/16 dated 10.03.2016.

     The borderlines of areas of compulsory (non-compulsory) pilotage and the procedure for rendering pilotage services by the FSUE “Rosmorport” Anadyr Branch in the seaports of Anadyr, Pevek and Providenya are specified in the section “Anadyr Branch Pilotage Services”.

     Pilotage dues in the seaports of Pevek and Provideniya include payment for the vehicles used for delivery and disembarkation of the pilot from the vessel.

     In accordance with the FSUE “Rosmorport” order No. 555 of 15.12.2020 (amended on 16.12.2021, on 08.06.2022, on 16.12.2022), pilotage dues in the seaport of Anadyr do not include payment for the vehicles used for delivery and disembarkation of the pilot to/from the vessel. Delivery and disembarkation of the pilot of the Anadyr branch performing pilotage in the seaport of Anadyr is effected on account of the vessel owner (client). 

     Pilotage dues are paid for each mile of pilotage. An incomplete mile is considered full.

     Pilotage dues are paid for each independent pilotage, including

     1) anchoring, buoy mooring;

     2) weighing, buoy mooring;

     3) mooring at berth;

     4) unmooring from berth;

     5) docking and undocking of a vessel.

     Pilotage dues for pilotage between terminals, the terminal and the roads and backwards are paid by the rates of pilotage for each mile. Incomplete mile is considered full.

     The coefficient 0.8 is applied to the rates of pilotage dues for vessels (except passenger vessels), which work on the lines, according to the procedure established by Russian legislation.

     In order to calculate the amount of pilotage dues gross registered tonnage of small size vessels, sport sailing vessels and leisure boats is determined under Clauses 1.7 of Order of FAS of Russia No 223/16 dated 10.03.2016.

     In accordance with FSUE “Rosmorport” order No. 555 of 15.12.2020 (amended on 16.12.2021, on 08.06.2022, on 16.12.2022) in order to calculate the amount of pilotage dues in the seaports of Anadyr, Pevek and Providenya a vessel with gross registered tonnage less than 3,000 is considered equal to a vessel with gross registered tonnage of 3,000.     

     When shifting a vessel with a pilot aboard along a berth, pilotage dues are paid for the operation with the coefficient 0.5.

     In case of refusal from services of a pilot sent aboard pilotage dues are paid in the amount of 50% dues for pilotage and operation due for a service that a pilot was sent for.

     Vessels carrying out operations for maintenance of vessels in the water area of the seaports of Anadyr, Pevek and Providenya and on the approaches toward them, including the internal and external roads, the infrastructure of the corresponding seaports, pay pilotage dues according to the rates of coastal shipping.

 

Lighthouse Dues


     Lighthouse dues are charged for call at the seaports of Anadyr, Beringovsky, Egvekinot, and Provideniya and the exit of the vessel from the seaport or transiting through the corresponding seaport water area.

 

Navigation Dues

 

     Navigation dues are charged in the seaports of Anadyr, Beringovsky, Egvekinot, and Providenya for entering the seaports of Anadyr, Beringovsky, Egvekinot, and Provideniya and vessel’s departure from the corresponding seaport. For vessels transiting through the water areas of the seaports of Anadyr, Beringovsky, Egvekinot, and Provideniya navigation dues are charged at the rate of navigation dues elated to the VTS.

     During consecutive loading or unloading in the seaports of Anadyr, Beringovsky, Egvekinot, and Provideniya within one sailing vessels, except passenger vessels, which do not work on the lines opened according to the procedure established by Russian legislation, pay navigation dues in full at the first seaport call and pay dues in the following seaports by applying the coefficient of 0.5 to the determined rates of navigation dues.

     Passenger vessels pay navigation dues in each seaport of call once over a calendar year at the rate of navigation dues when first entering the seaports of Anadyr, Beringovsky, Egvekinot, and Provideniya and exiting from the corresponding seaport.

     Starting from the second call at the seaports of Anadyr, Beringovsky, Egvekinot, and Provideniya passenger vessels pay navigation dues at the rate of navigation dues related to VTMS for each port call and departure from the corresponding seaport. Starting from the second call at the seaports of Anadyr, Beringovsky, Egvekinot, and Provideniya where the rate of navigation dues related to VTS has not been established passenger vessels pay navigation dues with the coefficient of 0.25 to the determined rates for each call at the seaport and a vessel's departure from the corresponding seaport.

     The coefficient, 0.8, is applied to the rate of navigation dues for vessels (except passenger vessels),that work on the lines opened in accordance with the procedure established by Russian legislation.

 

Water area transport security dues

 

     Transportation security dues in the water area of the seaport are charged for calling at the seaports of Anadyr, Pevek, and Provideniya and a vessel's departure from the seaport or its transit through the water area of the corresponding seaport.

     Levying of water area transport security dues in the seaports of Beringovsky and Egvekinot is carried out either after approval by FSUE “Rosmorport” of temporary water area transport security dues in the seaports of Beringovsky and Egvekinot, charged by FSUE “Rosmorport” in accordance with Ministry of Transport Order No. 387 dated 31.10.2012 before approval of water area transport security dues in the seaports of Beringovsky and Egvekinot by the State Regulation Authority in the prescribed order, or in accordance with the State Regulation Authority Order on establishment of water area transport security dues in the seaports of Beringovsky and Egvekinot came into force in the prescribed order.

     Water area transport security dues charged for the services rendered by the Anadyr Branch in the seaports of Anadyr, Pevek, and Provideniya are not applied to:

     - Russian vessels engaged in fishing in the inland waters, territorial sea, exclusive economic zone, continental shelf of the Russian Federation, the purpose of which is delivering water catches of biological resources, as well as fish and other products produced from them, for processing or sale in the territory of the Russian Federation;

     - Russian vessels performing fishing in the areas where Russian international treaties in the field of fishing and protecting biological resources and in the open area of the World Ocean and delivering them to the territory of the Russian Federation for the purpose of the subsequent realization.

 

3. Procedure for Paying Harbor Dues to the FSUE “Rosmorport” Anadyr Branch


     Harbor dues charged by the Anadyr Branch at the seaports of Anadyr, Beringovsky, Egvekinot, Pevek and Provideniya are paid by ship owners, shipowner's agents and other persons authorized by the shipowner in accordance with the terms of the standard contract for the services of ship navigation and stay in the seaports and approaches to them (hereinafter - the Contract).

     The contract shall be concluded by its acceptance, in particular, without signing it by the parties thereto, and shall be as valid as a contract signed by the parties.

     Acceptance shall be deemed any written notice of a vessel call to a seaport sent by the shipowner (agent or other person authorized by the shipowner) in accordance with the mandatory regulations being in force at the respective seaport, or carrying out conclusive actions aimed at obtaining the services provided by the enterprise in connection with the vessel call/exit and its stay in the seaport, as well as with its transit passage through the seaport water area.

     Acceptance of the offer to provide vessel pilotage services in accordance with the Contract shall be deemed the submission of a request by the shipowner (agent or other person authorized by the shipowner) for the provision of this type of services.

     For payment of harbor dues, the shipowner (shipowner's agent, other authorized representative of the shipowner) should send the application for harbor dues payment and a copy of documents confirming the authority of the shipowner's agent or other person authorized to represent the shipowner, certified by the signature of the head and seal of the organization, to the Anadyr Branch by fax: +7 (42722) 241-16, or in the scanned form to the following e-mail address: mail@and.rosmorport.ru It is recommended that a duly executed application be sent three days before the vessel enters the relevant seaport. The application will be reviewed by the Anadyr Branch within 24 hours, and to the email address of the shipowner (agent of the shipowner, another authorized person of the shipowner) or through the electronic document management system, a formalized invoice for payment of harbor dues will be sent in the form of Appendix No. 2 to the Contract, which must be paid in accordance with the terms of the Contract. The number of the invoice issued by the Anadyr Branch must be indicated in the payment documents. The branch sends the original invoice for the payment of harbor dues by mail or courier at the following address: 11 Vitusa Beringa St., Anadyr, Chukotka Autonomous Okrug, Russia.

 

     In case of non-payment of port fees in accordance with the terms of the Contract, the Anadyr Branch has the right to apply to the captain of the relevant seaport for refusal to issue permission for the vessel’s departure in accordance with Subparagraph 4 of Paragraph 1 of Article 80 of the Commercial Navigation Code of the Russian Federation.

 

II.  Tariffs for Services Rendered by FSUE “Rosmorport” Anadyr Branch

 

Towing Services

 

     The FSUE “Rosmorport” Anadyr Branch renders towing services related to towing support in mooring, de-mooring, shifting and other movement in the water areas of the seaports of Providenya and Egvenkinot. The Branch also renders services for sea towing of vessels.

     The conditional volume of a vessel in tow is calculated as the product of three variables specified in the certificate of measurement or in the certificate of classification: overall length, overall breadth and overall depth of a vessel.

     Price of towing service per one operation is established by multiplying towing services tariff by the conditional volume of a towing vessel.

     One operation amounts to towing support in anchoring or de-berthing, or shifting of a vessel along the terminal at a distance of no less than a vessel's length. A vessel's shifting at the distance of more than a vessel's length or a vessel's relocation in the seaport is considered two operations.

     In accordance with the Compulsory Regulations in the seaport of Provideniya approved by the order No. 378 of 23.10.2018 of the Russian Transport Ministry, navigation in the seaport of Provideniya is active from June till November. Information about the beginning and the ending of the navigation period is annually provided to mariners by the port captain of the seaport of Provideniya. 

     In accordance with the Compulsory Regulations in the seaport of Egvekinot approved by the order No. 342 of 22.18.2017 of the Russian Transport Ministry, navigation in the seaport of Egvekinot is active from July till November. Information about the beginning and the ending of the navigation period is annually provided to mariners by the port captain of the seaport of Egvekinot . 

 

     B) Tariffs for sea towing services

     The price of sea towing services is calculated based on the effective time of using a vessel in minutes with the following conversion of minutes to hours. The time in hours is taken into account with three places after the point.

     The terms for rendering towing services and the payment of these services rendered by the Anadyr Branch are provided by the clauses of services contract signed according to the procedure established in the section “Anadyr Branch Towing Services” .

 

Services for Providing Crew Boats

 

     The Anadyr Branch renders services in the seaports of Egvekinot and Providenya for providing crew boats for delivery (removal) of a crew, a marine agent (representatives of a marine agent, a vessel owner), members of a commission of the checkpoint through Russia's border, documents, cargoes and goods aboard a vessel.
